১৩। (১) কর্তৃপক্ষের প্রধান দায়িত্ব ও কার্যাবলী হইবে বিজ্ঞানসম্মত পদ্ধতির যথাযথ অনুশীলনের মাধ্যমে নিরাপদ খাদ্যের প্রাপ্যতা নিশ্চিতকরণে খাদ্য উৎপাদন, আমদানি, প্রক্রিয়াকরণ, মজুদ, সরবরাহ ও বিক্রয় সংশ্লিষ্ট কার্যক্রম নিয়ন্ত্রণ ও পরিবীক্ষণ এবং নিরাপদ খাদ্য ব্যবস্থাপনার সহিত সংশ্লিষ্ট সকল সংস্থার কার্যাবলীর সমন্বয় সাধন করা। (২) উপ-ধারা (১) এর সামগ্রিকতাকে ক্ষুণ্ণ না করিয়া, কর্তৃপক্ষ নিম্নবর্ণিত দায়িত্ব পালন করিবে, যথা :- (ক) নিরাপদতার নিরিখে, উদ্ভিজ্জ, প্রাণীজ ও অন্যান্য প্রধান উৎস হইতে প্রাপ্ত খাদ্যসমূহের বিজ্ঞানসম্মত সংজ্ঞায়ন এবং উহাদের গুণগত মান সুনির্দিষ্টকরণে সংশ্লিষ্ট কর্তৃপক্ষ বা সংস্থাকে প্রয়োজনীয় সহযোগিতা প্রদান এবং উহাদের কার্যাবলী বাস্তবায়ন পরিবীক্ষণ; (খ) বিদ্যমান আইনের অধীন অন্য কোন কর্তৃপক্ষ বা সংস্থা কর্তৃক নির্ধারিত খাদ্যের গুণগত মান (standard) বা নির্দেশনা (guideline) নিরাপদতার সর্বোচ্চ মানে হালনাগাদ বা উন্নীতকরণে সংশ্লিষ্ট কর্তৃপক্ষ বা সংস্থাকে প্রয়োজনীয় সহযোগিতা প্রদান; (গ) বিদ্যমান কোন আইনের অধীন কোন খাদ্যের গুণগত মান বা নির্দেশনা নির্ধারণ করা না হইলে, সংশ্লিষ্ট খাদ্যের গুণগত মানদণ্ড বা নির্দেশনা নির্ধারণ; (ঘ) বিদ্যমান আইনের অধীন অন্য কোন কর্তৃপক্ষ বা সংস্থা কর্তৃক নির্ধারিত খাদ্যদ্রব্যে দূষক বা দূষণকারী জীবাণু (microbial contaminants), সার, কীটনাশক বা বালাইনাশকের অবশিষ্টাংশ, পশুরোগ বা মৎস্যরোগ বিষয়ক ঔষধের অবশিষ্টাংশ, ভারী-ধাতু (heavy metal), প্রক্রিয়াকরণ সহায়ক (processing aid), খাদ্য সংযোজন বা সংরক্ষণ দ্রব্য (food additive or preservative), মাইকোটক্সিন, এন্টিবায়োটিক, ঔষধ সংক্রান্ত সক্রিয় বস্ত্ত এবং বৃদ্ধি প্রবর্ধক (growth promoter), ব্যবহারের সহনীয় মাত্রা নিরাপদতার সর্বোচ্চ মানে হালনাগাদ বা উন্নীতকরণে সংশ্লিষ্ট কর্তৃপক্ষ বা সংস্থাকে প্রয়োজনীয় সহযোগিতা প্রদান এবং বাস্তবায়ন পরিবীক্ষণ; (ঙ) বিদ্যমান কোন আইনের অধীন খাদ্যদ্রব্যে দূষক বা দূষণকারী জীবাণু, সার, কীটনাশক বা বালাইনাশকের অবশিষ্টাংশ, পশুরোগ বা মৎস্যরোগ বিষয়ক ঔষধের অবশিষ্টাংশ, ভারী-ধাতু, প্রক্রিয়াকরণ সহায়ক, খাদ্য সংযোজন বা সংরক্ষণ দ্রব্য, মাইকোটক্সিন, এন্টিবায়োটিক, ঔষধ সংক্রান্ত সক্রিয় বস্ত্ত এবং বৃদ্ধি প্রবর্ধক ব্যবহারের সহনীয় মাত্রা নির্ধারণ করা না হইলে, বিজ্ঞানসম্মত উপায়ে উহাদের সহনীয় মাত্রা নির্ধারণ; (চ) খাদ্যে তেজস্ক্রিয়তার সহনীয় মাত্রা সুনির্দিষ্টকরণে সংশ্লিষ্ট কর্তৃপক্ষ বা সংস্থাকে প্রয়োজনীয় সহযোগিতা প্রদান এবং বাস্তবায়ন পরিবীক্ষণ; (ছ) খাদ্য ব্যবসার ক্ষেত্রে, নিরাপদ খাদ্য ব্যবস্থাপনা পদ্ধতির সনদের জন্য, সনদ প্রদানকারী সংস্থাসমূহের জন্য অনুসরনীয় এ্যাক্রেডিটেনশনের নীতিমালা প্রণয়ন ও বাস্তবায়নের সংশ্লিষ্ট কর্তৃপক্ষ বা সংস্থাকে প্রয়োজনীয় সহযোগিতা প্রদান; (জ) খাদ্য পরীক্ষাগারের এ্যাক্রেডিটেনশনের জন্য অনুসরণীয় নীতিমালা প্রণয়নে সংশ্লিষ্ট কর্তৃপক্ষ বা সংস্থাকে প্রয়োজনীয় সহযোগিতা প্রদান এবং বাস্তবায়ন পরিবীক্ষণ; (ঝ) খাদ্যের ভেজাল ও মান নিরূপণে পরিচালিত পরীক্ষাগার পরিবীক্ষণ এবং পরিবীক্ষণকালে পরিলক্ষিত ক্রটি-বিচ্যুতির বিষয়ে অনতিবিলম্বে প্রয়োজনীয় ব্যবস্থা গ্রহণের জন্য সংশ্লিষ্ট কর্তৃপক্ষকে প্রয়োজনীয় পরামর্শ প্রদান; (ঞ) বিদ্যমান কোন আইনের অধীন আমদানিতব্য খাদ্যদ্রব্যের মানদন্ড ও পরীক্ষণ পদ্ধতি নির্ধারণ করা না হইলে উক্ত খাদ্যদ্রব্যের মানদন্ড ও পরীক্ষণ পদ্ধতি নির্ধারণ এবং তদ্ভিত্তিতে উক্ত খাদ্যদ্রব্যের গুণগত মান নিশ্চিতকরণে সংশ্লিষ্ট কর্তৃপক্ষ বা সংস্থাকে প্রয়োজনীয় সহযোগিতা প্রদান এবং বাস্তবায়ন পরিবীক্ষণ; (ট) খাদ্য মোড়কীকরণ এবং মোড়কাবদ্ধ খাদ্যের স্বাস্থ্য, পুষ্টি, বিশেষ পথ্য গুণ ও শ্রেণীবিন্যাস সম্পর্কিত দাবী প্রকাশের পদ্ধতি নির্ধারণ এবং উহা বাস্তবায়নে সংশ্লিষ্ট কর্তৃপক্ষ বা সংস্থাকে প্রয়োজনীয় সহযোগিতা প্রদান; (ঠ) সম্ভাব্য ঝুঁকি নিরূপণ, বিশ্লেষণ, অবহিতকরণ ও ব্যবস্থাপনার পদ্ধতি নির্ধারণ এবং ক্রমবর্ধমান ঝুঁকি চিহ্নিতকরণ ও নিয়মিত সতর্কীকরণ পদ্ধতি চালুকরণ; এবং (ড) খাদ্যের নমুনা গ্রহণ ও বিশ্লেষণ এবং তৎসম্পর্কে আইন প্রয়োগকারী সংস্থার সহিত তথ্য বিনিময়; (৩) কর্তৃপক্ষ, উহার উপর অর্পিত দায়িত্ব পালন ও কার্য সম্পাদনে, নিম্নবর্ণিত পদক্ষেপ গ্রহণ করিবে, যথা:- (ক) খাদ্য ও পুষ্টি নিরাপত্তা বিষয়ক নীতিমালা বা বিধিমালা প্রণয়ন এবং বিদ্যমান নীতিমালা বা বিধিমালা সংশোধন বা হালনাগাদকরণে সরকারকে প্রয়োজনীয় বৈজ্ঞানিক পরামর্শ ও কারিগরি সহায়তা প্রদান; (খ) নিম্নবর্ণিত বিষয় সংশ্লিষ্ট বৈজ্ঞানিক ও কারিগরি তথ্য অনুসন্ধান, সংগ্রহ এবং তুলনা বিশ্লেষণ, যথা:- (অ) খাদ্য গ্রহণজনিত কারণে স্বাস্থ্য-ঝুঁকি চিহ্নিতকরণ; (আ) জৈবিক ঝুঁকির প্রাদুর্ভাব ও ব্যাপকতা চিহ্নিতকরণ; (ই) খাদ্যদ্রব্যে দূষিত বস্ত্তর মিশ্রণের প্রাদুর্ভাব ও ব্যাপকতা চিহ্নিতকরণ; (ঈ) খাদ্যদ্রব্যে দূষণকারী বস্ত্তর অবশিষ্টাংশের প্রাদুর্ভাব ও ব্যাপকতা চিহ্নিতকরণ; (গ) সম্ভাব্য ঝুঁকি নিরূপণ, পদ্ধতি উদ্ভাবন এবং সংশ্লিষ্ট সকলের সমন্বয়ে বিদ্যমান পদ্ধতি হালনাগাদ বা উন্নীতকরণে প্রয়োজনীয় উদ্যোগ গ্রহণ ও বাস্তবায়ন পরিবীক্ষণ; (ঘ) খাদ্যদ্রব্যের স্বাস্থ্য ও পুষ্টি সংক্রান্ত ঝুঁকি বিষয়ক বার্তা সরকার এবং সংশ্লিষ্ট কর্তৃপক্ষ, সংস্থা ও কর্মকর্তাগণের নিকট প্রেরণ এবং উহা জনসাধারণকে অবহিতকরণের লক্ষ্যে প্রয়োজনীয় ব্যবস্থা গ্রহণ; (ঙ) নিরাপদ খাদ্যের সংকট ব্যবস্থাপনা পদ্ধতি বাস্তবায়নে সরকারকে প্রয়োজনীয় বৈজ্ঞানিক ও কারিগরি পরামর্শ এবং সহায়তা প্রদান; (চ) মাঠ পর্যায় পর্যন্ত নিরাপদ খাদ্য ব্যবস্থাপনার সহিত জড়িত কর্তৃপক্ষ বা সংস্থার মধ্যে তথ্য বিনিময়, সংশ্লিষ্ট বিষয়ে প্রকল্প প্রণয়ন ও বাস্তবায়নে সহযোগিতা প্রদান এবং এতদবিষয়ে বিদ্যমান অভিজ্ঞতা ও উত্তম অনুশীলন বিনিময়ের মাধ্যমে বৈজ্ঞানিক ও কারিগরি সহযোগিতা নেটওয়ার্ক প্রতিষ্ঠা; (ছ) আন্তর্জাতিক সংস্থাসমূহের সহযোগিতা গ্রহণে সরকারকে প্রয়োজনীয় বৈজ্ঞানিক ও কারিগরি পরামর্শ এবং সহায়তা প্রদান; (জ) এই আইন বাস্তবায়নের সহিত প্রত্যক্ষ বা পরোক্ষভাবে জড়িত এবং খাদ্য দ্রব্যের ব্যবসা পরিচালনায় নিয়োজিত ব্যক্তিবর্গের জন্য নিরাপদ খাদ্য সংক্রান্ত বিষয়ে প্রশিক্ষণের ব্যবস্থা গ্রহণ; (ঝ) খাদ্যদ্রব্য এবং স্যানিটারি ও ফাইটো-স্যানিটারির বিদ্যমান স্ট্যান্ডার্ডকে আন্তর্জাতিক স্ট্যান্ডার্ডে উন্নীতকরণে সংশ্লিষ্ট কর্তৃপক্ষ বা সংস্থাকে প্রয়োজনীয় সহায়তা প্রদান; (ঞ) খাদ্যের গুণগত মানের বিষয়ে সরকারি, বেসরকারি ও আন্তর্জাতিক সংস্থাসমূহের গৃহীত কার্যক্রম সমন্বয় সাধন; (ট) খাদ্য পরীক্ষা, গবেষণা ও মানদন্ড নির্ধারণ পদ্ধতি সংশ্লিষ্ট কার্যক্রমে নিয়োজিত কর্তৃপক্ষ বা সংস্থাসমূহের মধ্যে ফলপ্রসু যোগাযোগ স্থাপন; (ঠ) আন্তর্জাতিক খাদ্য ও দেশীয় খাদ্যের গুণগত মানের মধ্যে সমতা আনয়নের কৌশল নির্ধারণ; (ড) নিরাপদ খাদ্যের গুণগত মান সম্পর্কে জনসচেতনতা সৃষ্টি; এবং (ঢ) এই আইনের উদ্দেশ্য পূরণকল্পে, সরকার কর্তৃক, সময় সময়, নির্দেশিত অন্যান্য কার্যাদি সম্পাদন। (৪) এই ধারার উদ্দেশ্য পূরণকল্পে কর্তৃপক্ষ প্রবিধান প্রণয়ন করিবে। ব্যাখ্যা ।- এই ধারায়- (ক) ‘‘নিরাপদ খাদ্য ব্যবস্থাপনা পদ্ধতি’’ (Food Safety Management System)” অর্থ নিরাপদ ও স্বাস্থসম্মতভাবে খাদ্য উৎপাদন, প্রক্রিয়াকরণ, প্রস্ত্ততকরণ ও বিপণনে উৎকৃষ্ট পদ্ধতির (Good Agricultural Practices, Good Aquacultural Practices, Good Manufacturing Practices, Good Hygienic Practices) অনুশীলনসহ গ্রহণযোগ্য ব্যবস্থা, বিপত্তি বিশ্লেষণ (Hazard Analysis), সংকট-কালীন জরুরী খাদ্য নিরাপত্তা সাড়া (Food Safety Emergency Response), অবশিষ্টাংশ নিয়ন্ত্রণ পদ্ধতি (Residual Control System) ও খাদ্যের অনিরাপদতার উৎস নিরীক্ষা পদ্ধতি (Food Safety Auditing System) এবং সংশ্লিষ্ট বিষয়ের অনুশীলন, যাহা এতদসংক্রান্ত বিদ্যমান আইনে নির্ধারিত মানদণ্ড ও বাধ্যবাধকতা প্রতিপালন নিশ্চিতকল্পে খাদ্য ব্যবসা পরিচালনার জন্য অনুমোদিত নির্দেশনায় (approved guidance or directives) বিদ্যমান; এবং (খ) ‘‘বিপত্তি (Hazard)” অর্থ মানব-স্বাস্থ্যের প্রতিকূল কোন কারণের উদ্ভব করিতে পারে এইরূপ কোন জৈবিক, রাসায়নিক বা ভৌত, ইত্যাদি কারণে সৃষ্ট অথবা প্রাকৃতিকভাবে উৎপাদিত পদার্থের উপস্থিতি বা সৃষ্ট অবস্থা।

(ঞ) বিদ্যমান কোন আইনের অধীন আমদানিতব্য খাদ্যদ্রব্যের মানদন্ড ও পরীক্ষণ পদ্ধতি নির্ধারণ করা না হইলে উক্ত খাদ্যদ্রব্যের মানদন্ড ও পরীক্ষণ পদ্ধতি নির্ধারণ এবং তদ্ভিত্তিতে উক্ত খাদ্যদ্রব্যের গুণগত মান নিশ্চিতকরণে সংশ্লিষ্ট কর্তৃপক্ষ বা সংস্থাকে প্রয়োজনীয় সহযোগিতা প্রদান এবং বাস্তবায়ন পরিবীক্ষণ; (ট) খাদ্য মোড়কীকরণ এবং মোড়কাবদ্ধ খাদ্যের স্বাস্থ্য, পুষ্টি, বিশেষ পথ্য গুণ ও শ্রেণীবিন্যাস সম্পর্কিত দাবী প্রকাশের পদ্ধতি নির্ধারণ এবং উহা বাস্তবায়নে সংশ্লিষ্ট কর্তৃপক্ষ বা সংস্থাকে প্রয়োজনীয় সহযোগিতা প্রদান; (ঠ) সম্ভাব্য ঝুঁকি নিরূপণ, বিশ্লেষণ, অবহিতকরণ ও ব্যবস্থাপনার পদ্ধতি নির্ধারণ এবং ক্রমবর্ধমান ঝুঁকি চিহ্নিতকরণ ও নিয়মিত সতর্কীকরণ পদ্ধতি চালুকরণ; এবং (ড) খাদ্যের নমুনা গ্রহণ ও বিশ্লেষণ এবং তৎসম্পর্কে আইন প্রয়োগকারী সংস্থার সহিত তথ্য বিনিময়; (৩) কর্তৃপক্ষ, উহার উপর অর্পিত দায়িত্ব পালন ও কার্য সম্পাদনে, নিম্নবর্ণিত পদক্ষেপ গ্রহণ করিবে, যথা:- (ক) খাদ্য ও পুষ্টি নিরাপত্তা বিষয়ক নীতিমালা বা বিধিমালা প্রণয়ন এবং বিদ্যমান নীতিমালা বা বিধিমালা সংশোধন বা হালনাগাদকরণে সরকারকে প্রয়োজনীয় বৈজ্ঞানিক পরামর্শ ও কারিগরি সহায়তা প্রদান; (খ) নিম্নবর্ণিত বিষয় সংশ্লিষ্ট বৈজ্ঞানিক ও কারিগরি তথ্য অনুসন্ধান, সংগ্রহ এবং তুলনা বিশ্লেষণ, যথা:- (অ) খাদ্য গ্রহণজনিত কারণে স্বাস্থ্য-ঝুঁকি চিহ্নিতকরণ; (আ) জৈবিক ঝুঁকির প্রাদুর্ভাব ও ব্যাপকতা চিহ্নিতকরণ; (ই) খাদ্যদ্রব্যে দূষিত বস্ত্তর মিশ্রণের প্রাদুর্ভাব ও ব্যাপকতা চিহ্নিতকরণ; (ঈ) খাদ্যদ্রব্যে দূষণকারী বস্ত্তর অবশিষ্টাংশের প্রাদুর্ভাব ও ব্যাপকতা চিহ্নিতকরণ; (গ) সম্ভাব্য ঝুঁকি নিরূপণ, পদ্ধতি উদ্ভাবন এবং সংশ্লিষ্ট সকলের সমন্বয়ে বিদ্যমান পদ্ধতি হালনাগাদ বা উন্নীতকরণে প্রয়োজনীয় উদ্যোগ গ্রহণ ও বাস্তবায়ন পরিবীক্ষণ; (ঘ) খাদ্যদ্রব্যের স্বাস্থ্য ও পুষ্টি সংক্রান্ত ঝুঁকি বিষয়ক বার্তা সরকার এবং সংশ্লিষ্ট কর্তৃপক্ষ, সংস্থা ও কর্মকর্তাগণের নিকট প্রেরণ এবং উহা জনসাধারণকে অবহিতকরণের লক্ষ্যে প্রয়োজনীয় ব্যবস্থা গ্রহণ; (ঙ) নিরাপদ খাদ্যের সংকট ব্যবস্থাপনা পদ্ধতি বাস্তবায়নে সরকারকে প্রয়োজনীয় বৈজ্ঞানিক ও কারিগরি পরামর্শ এবং সহায়তা প্রদান; (চ) মাঠ পর্যায় পর্যন্ত নিরাপদ খাদ্য ব্যবস্থাপনার সহিত জড়িত কর্তৃপক্ষ বা সংস্থার মধ্যে তথ্য বিনিময়, সংশ্লিষ্ট বিষয়ে প্রকল্প প্রণয়ন ও বাস্তবায়নে সহযোগিতা প্রদান এবং এতদবিষয়ে বিদ্যমান অভিজ্ঞতা ও উত্তম অনুশীলন বিনিময়ের মাধ্যমে বৈজ্ঞানিক ও কারিগরি সহযোগিতা নেটওয়ার্ক প্রতিষ্ঠা; (ছ) আন্তর্জাতিক সংস্থাসমূহের সহযোগিতা গ্রহণে সরকারকে প্রয়োজনীয় বৈজ্ঞানিক ও কারিগরি পরামর্শ এবং সহায়তা প্রদান; (জ) এই আইন বাস্তবায়নের সহিত প্রত্যক্ষ বা পরোক্ষভাবে জড়িত এবং খাদ্য দ্রব্যের ব্যবসা পরিচালনায় নিয়োজিত ব্যক্তিবর্গের জন্য নিরাপদ খাদ্য সংক্রান্ত বিষয়ে প্রশিক্ষণের ব্যবস্থা গ্রহণ; (ঝ) খাদ্যদ্রব্য এবং স্যানিটারি ও ফাইটো-স্যানিটারির বিদ্যমান স্ট্যান্ডার্ডকে আন্তর্জাতিক স্ট্যান্ডার্ডে উন্নীতকরণে সংশ্লিষ্ট কর্তৃপক্ষ বা সংস্থাকে প্রয়োজনীয় সহায়তা প্রদান; (ঞ) খাদ্যের গুণগত মানের বিষয়ে সরকারি, বেসরকারি ও আন্তর্জাতিক সংস্থাসমূহের গৃহীত কার্যক্রম সমন্বয় সাধন; (ট) খাদ্য পরীক্ষা, গবেষণা ও মানদন্ড নির্ধারণ পদ্ধতি সংশ্লিষ্ট কার্যক্রমে নিয়োজিত কর্তৃপক্ষ বা সংস্থাসমূহের মধ্যে ফলপ্রসু যোগাযোগ স্থাপন; (ঠ) আন্তর্জাতিক খাদ্য ও দেশীয় খাদ্যের গুণগত মানের মধ্যে সমতা আনয়নের কৌশল নির্ধারণ; (ড) নিরাপদ খাদ্যের গুণগত মান সম্পর্কে জনসচেতনতা সৃষ্টি; এবং (ঢ) এই আইনের উদ্দেশ্য পূরণকল্পে, সরকার কর্তৃক, সময় সময়, নির্দেশিত অন্যান্য কার্যাদি সম্পাদন। (৪) এই ধারার উদ্দেশ্য পূরণকল্পে কর্তৃপক্ষ প্রবিধান প্রণয়ন করিবে। ব্যাখ্যা ।- এই ধারায়- (ক) ‘‘নিরাপদ খাদ্য ব্যবস্থাপনা পদ্ধতি’’ (Food Safety Management System)” অর্থ নিরাপদ ও স্বাস্থসম্মতভাবে খাদ্য উৎপাদন, প্রক্রিয়াকরণ, প্রস্ত্ততকরণ ও বিপণনে উৎকৃষ্ট পদ্ধতির (Good Agricultural Practices, Good Aquacultural Practices, Good Manufacturing Practices, Good Hygienic Practices) অনুশীলনসহ গ্রহণযোগ্য ব্যবস্থা, বিপত্তি বিশ্লেষণ (Hazard Analysis), সংকট-কালীন জরুরী খাদ্য নিরাপত্তা সাড়া (Food Safety Emergency Response), অবশিষ্টাংশ নিয়ন্ত্রণ পদ্ধতি (Residual Control System) ও খাদ্যের অনিরাপদতার উৎস নিরীক্ষা পদ্ধতি (Food Safety Auditing System) এবং সংশ্লিষ্ট বিষয়ের অনুশীলন, যাহা এতদসংক্রান্ত বিদ্যমান আইনে নির্ধারিত মানদণ্ড ও বাধ্যবাধকতা প্রতিপালন নিশ্চিতকল্পে খাদ্য ব্যবসা পরিচালনার জন্য অনুমোদিত নির্দেশনায় (approved guidance or directives) বিদ্যমান;
