৮।(১) কমিশনের দায়িত্ব, ক্ষমতা ও কার্যাবলী হইবে নিম্নরূপ, যথাঃ- (ক) বাজারে প্রতিযোগিতার ক্ষেত্রে বিরূপ প্রভাব বিস্তারকারী অনুশীলনসমূহকে নির্মূল করা, প্রতিযোগিতাকে উৎসাহিত করা ও বজায় রাখা এবং ব্যবসা-বাণিজ্যের স্বাধীনতাকে নিশ্চিত করা; (খ) কোন অভিযোগের ভিত্তিতে অথবা স্ব-প্রণোদিতভাবে ব্যবসা প্রতিষ্ঠানসমূহের প্রতিযোগিতা বিরোধী সকল চুক্তি, কর্তৃত্বময় অবস্থান এবং অনুশীলনের তদন্ত করা; (গ) ধারা ১৮ এর প্রাসংগিকতাকে ক্ষুণ্ন না করিয়া এই আইনে উল্লিখিত অন্যান্য অপরাধের তদন্ত পরিচালনা এবং উহার ভিত্তিতে মামলা দায়ের ও পরিচালনা করা; (ঘ) জোটবদ্ধতা এবং জোটবদ্ধতা সংশ্লিষ্ট বিষয়াদি, জোটবদ্ধতার জন্য তদন্ত সম্পাদনসহ জোটবদ্ধতার শর্তাদি এবং জোটবদ্ধতা অনুমোদন বা নামঞ্জুর সংক্রান্ত বিষয়াদি নির্ধারণ করা; (ঙ) প্রতিযোগিতা সংক্রান্ত বিধিমালা, নীতিমালা, দিক নির্দেশনামূলক পরিপত্র বা প্রশাসনিক নির্দেশনা প্রণয়ন এবং উহা বাস্তবায়নে সরকারকে পরামর্শ ও সহযোগিতা প্রদান করা; (চ) প্রতিযোগিতামূলক কর্মকাণ্ডের উন্নয়ন এবং প্রতিযোগিতা সংক্রান্ত বিষয়ে প্রশিক্ষণ প্রদানের জন্য উপযুক্ত মানদণ্ড নির্ধারণ করা; (ছ) সমাজের বিভিন্ন শ্রেণীর লোকজনের মধ্যে প্রতিযোগিতা সম্পর্কিত সার্বিক বিষয়ে প্রচার এবং প্রকাশনার মাধ্যমে ও অন্যান্য উপায়ে জনগণের মাঝে সচেতনতা বৃদ্ধির লক্ষ্যে প্রয়োজনীয় কর্মসূচী গ্রহণ করা; (জ) প্রতিযোগিতা বিরোধী কোন চুক্তি বা কর্মকাণ্ড বিষয়ে গবেষণা, সেমিনার, সিম্পোজিয়াম, ওয়ার্কশপ এবং অনুরূপ অন্যবিধ ব্যবস্থার মাধ্যমে গণসচেতনতা বৃদ্ধি করা এবং গবেষণালব্ধ ফলাফল প্রকাশ ও প্রচার করা এবং উহাদের কার্যকর বাস্তবায়নের জন্য সরকারের নিকট সুপারিশ করা; (ঝ) সরকার কর্তৃক প্রেরিত প্রতিযোগিতা সংক্রান্ত যে কোন বিষয় প্রতিপালন, অনুসরণ বা বিবেচনা করা; (ঞ) ভোক্তা অধিকার সংরক্ষণ ও বাস্তবায়নের বিষয়ে অন্য কোন আইনের অধীন গৃহীত ব্যবস্থাদি পর্যালোচনা করা; (ট) এই ধারার অধীন দায়িত্ব পালনের জন্য বা ইহার কার্যাবলী সুষ্ঠুভাবে সম্পাদনের প্রয়োজনে, সরকারের পূর্বানুমোদনক্রমে, বিদেশী কোন সংস্থার সহিত কোন চুক্তি বা সমঝোতা স্মারক (MoU) স্বাক্ষর ও সম্পাদন করা; (ঠ) এই আইনের উদ্দেশ্য পূরণকল্পে ফিস, চার্জ বা অন্য কোন খরচ ধার্য করা; এবং (ড) এই আইনের উদ্দেশ্য পূরণকল্পে বিধি দ্বারা নির্ধারিত অন্য যে কোন কার্য করা। (২) কমিশন স্ব-প্রণোদিত হইয়া অথবা কোন অভিযোগের ভিত্তিতে এই আইনের অধীন উত্থাপিত অভিযোগ সম্পর্কে অনুসন্ধান করিতে পারিবে। (৩) নিম্নবর্ণিত বিষয়ে Code of Civil Procedure, 1908 (Act V of 1908) এর অধীন একটি দেওয়ানী আদালত যে ক্ষমতা প্রয়োগ করিতে পারিবে কমিশন বা, ক্ষেত্রমত, চেয়ারপার্সন বা কোন সদস্যও এই ধারার অধীন সেইরূপ ক্ষমতা প্রয়োগ করিতে পারিবেন, যথাঃ- (ক) কোন ব্যক্তিকে কমিশনে হাজির করিবার জন্য নোটিশ জারী করা ও উপস্থিতি নিশ্চিত করা; (খ) কোন দলিল উদঘাটন ও উপস্থাপন করা; (গ) তথ্য যাচাই ও পরিদর্শন করা; (ঘ) কোন অফিস হইতে প্রয়োজনীয় কাগজাদি বা উহার অনুলিপি তলব করা; (ঙ) সাক্ষীর জিজ্ঞাসাবাদ এবং দলিল পরীক্ষা করিবার জন্য নোটিশ জারী করা; (চ) এই উপ-ধারার উদ্দেশ্য পূরণকল্পে যে কোন বিষয়ে পদক্ষেপ গ্রহণ করা। (৪) কমিশন যে কোন ব্যক্তিকে তদন্ত সংশ্লিষ্ট বিষয়ে কোন তথ্য সরবরাহ করিবার জন্য তাহার হেফাজতে বা নিয়ন্ত্রণে থাকা এইরূপ কোন বই, হিসাব বা অন্যান্য দলিল, যাহা বাণিজ্যিক লেনদেনের সহিত সংশ্লিষ্ট এবং এই আইনের উদ্দেশ্য পূরণকল্পে পরীক্ষা করা আবশ্যক, উক্তরূপ বিষয়াদি কমিশন বা তদ্কর্তৃক ক্ষমতাপ্রাপ্ত কোন কর্মকর্তার নিকট উপস্থাপন করিবার জন্য নির্দেশ প্রদান করিতে পারিবে এবং অনুরূপভাবে নির্দেশিত ব্যক্তি তাহার হেফাজতে রক্ষিত উক্ত তথ্য সরবরাহ করিতে বাধ্য থাকিবে। (৫) কমিশন কোন তদন্ত বা কার্যধারা পরিচালনার ক্ষেত্রে উহাকে সহায়তা প্রদানের জন্য অর্থনীতি, ব্যবসা-বাণিজ্য, হিসাববিজ্ঞান অথবা অন্য কোন ক্ষেত্র হইতে প্রয়োজনীয় সংখ্যক বিশেষজ্ঞকে আমন্ত্রণ জানাইতে পারিবে এবং উক্তরূপ সহায়তা প্রদানের জন্য কমিশনের নির্দেশনা অনুসারে সংশ্লিষ্ট ব্যক্তি যথাযথ উদ্যোগ গ্রহণ করিবেন। (৬) কমিশনের সম্মুখে সকল কার্যধারা Penal Code, 1860 (Act XLV of 1860) এর section 196 এর উদ্দেশ্য পূরণকল্পে এবং section 193 এবং 228 এর অধীন বিচারিক কার্যধারা বলিয়া গণ্য হইবে, এবং Code of Criminal Procedure, 1898 (Act V of 1898) এর chapter 35 এবং section 195 এর উদ্দেশ্য পূরণকল্পে, কমিশন একটি দেওয়ানী আদালত (Civil Court) বলিয়া গণ্য হইবে। (৭) চেয়ারপার্সন বা কমিশন হইতে বৈধ ক্ষমতাপ্রাপ্ত কোন কর্মকর্তাকে উপ-ধারা (৩) এর অধীন ক্ষমতা প্রয়োগে কোন ব্যক্তি বাধা প্রদান করিলে বা উক্ত উপ-ধারার অধীন প্রদত্ত কোন নির্দেশ ইচ্ছাকৃতভাবে কোন ব্যক্তি অমান্য করিলে উহা এই আইনের অধীন একটি দণ্ডনীয় অপরাধ হইবে এবং উক্ত অপরাধের জন্য সংশ্লিষ্ট ব্যক্তি অনূর্ধ্ব ৩(তিন) বৎসর পর্যন্ত যে কোন মেয়াদের কারাদণ্ডে বা অর্থদণ্ডে বা উভয় প্রকার দণ্ডে দণ্ডনীয় হইবেন।
