- Disaster Management Act 2012 (Act No. 34 of 2012), Section 5; Standing Orders on Disaster (SOD) 2019 operationalise the Council's directives at district, upazila, and union levels. The Act grants the Council authority to co-opt additional members and directs that if no minister is assigned to a designated ministry, the Minister of State or Deputy Minister of that ministry serves as member.

The National Disaster Management Council (NDMC) is the apex body for disaster management in Bangladesh, established by Section 5 of the Disaster Management Act 2012 (Act No. 34 of 2012). The chairperson is the Prime Minister ex officio; member designations confirmed across multiple sources include: ministers for Finance, Planning, Home Affairs, Defence, Water Resources, Local Government and Rural Development, Communications, Health and Family Welfare, Agriculture, and Disaster Management and Relief. The Act allows the Government to increase or decrease membership and permits co-option of additional persons. The Ministry of Disaster Management and Relief (MoDMR) serves as the NDMC secretariat; the Department of Disaster Management (DDM) is the primary implementing body.
